These website terms of use (“Website Terms of Use”) govern the use of the website trinityorganplacementservices.com (the “Site”).

The Site is owned and/or controlled by or on behalf of Trinity Air Medical, LLC, an Arizona Limited Liability Company having its registered office at 1437 W Auto Drive, Tempe, Arizona 85284 (“Trinity”, “we”, “us” or “our”).

The purpose of the Site is to provide the Site’s visitors (“User” or “you”) with information regarding the activities of Trinity, including access to a set of elements making up the Site, in particular data, graphics, sound, artwork, computer code, texts, logos, images, videos, icons, databases, and software and/or sounds (“Content”).

By accessing or using the Site, User agrees that he/she has read, understands, accepts and agrees to be bound by and act in accordance with these Website Terms of Use.

These Website Terms of Use cover your use of the Site. For other Trinity services, you may be required to accept additional terms which apply to those services.

Access and availability

The Site is normally accessible at any time, except in cases of force majeure or technical incident. Trinity may also interrupt the access to the Site or to all or part of the Content for maintenance purposes. The User acknowledges and agrees that Trinity should not be held responsible for any consequences that may result from such interruptions.

Trinity also reserves the right to restrict User’s access to all or any component of the Site, or remove or edit Content of the Site, at any time and without advance notice or liability.

Trinity strives to publish information and Content on the Site that is as accurate as possible. Trinity cannot, however, guarantee the accuracy and completeness of all this information which is provided on an indicative basis only. The information, software, products and services on the Site may therefore include inaccuracies or typographical errors, any of which Trinity reserves the right to correct even post-confirmation without liability. The User acknowledges and agrees that Trinity should not be held responsible for any consequences that may result from misused and/or inaccurate or incomplete information.

The User undertakes to take all appropriate measures to protect and ensure the security of his/her data and IT equipment when accessing and using the Site, notably by using a recent device, free of viruses, with an up-to-date browser.

Trinity does not have the ability to control or modify the content of these third-party resources and, therefore, is not responsible for them, in particular for the content, advertising, products, services or any other information available from these websites

Intellectual property

The Site and the Content are the exclusive property of Trinity or are subject to a license granted to Trinity by the relevant owners. The use of the Site and Content does not grant the User any intellectual property right over these elements, which are and shall remain the exclusive property of Trinity or its licensors.

The User is only granted a free, limited, personal, non-exclusive and non-transferable right to access and visit the Site and the Content, in an exclusively private context and subject to acceptance and compliance with these Website Terms of Use. Such right is granted to the User exclusively in the country from which the User accesses the Site and the Content and only during the period of availability of the Content on the Site and/or availability of the Site, as determined by Trinity at its sole discretion.

User may not reproduce, duplicate, represent, modify, copy, distribute, display, sell, transfer, publish, create derivative works from or otherwise exploit for any purpose the Content, software, products, or services or data found on the Site, except with the prior written consent of Trinity. Any unauthorized use of the Site or Content may constitute an infringement incurring the liability of the offender.

User’s responsibility

The User accesses and uses the Site and the Content at his/her sole responsibility and at his/her own risk.

The User undertakes not to:

  • access, monitor or copy any Content or information on the Sites using any robot, spider, scraper or other automated means or any manual process for any purpose without Trinity’s express written permission;
  • violate the restrictions in any robot exclusion headers on this Site or hinder the proper operation of the Site, in particular not to circumvent technical protection systems, carry out or encourage hacking, introduce viruses, disrupt or limit the functionalities of the Site or of any software or hardware used in connection with the Site;
  • take any action that imposes, or may impose, in the discretion of Trinity, an unreasonable or disproportionately large load on the Trinity’s infrastructure;
  • deep-link to any portion of this Site (including where applicable, without limitation, the purchase path for any travel services) for any purpose without Trinity’s express written permission;
  • use the Site for any speculative, false, or fraudulent purposes; or
  • infringe the rights or damage the reputation of Trinity or any third party.

The User also undertakes not to use these Site for any purpose that is unlawful and/or prohibited by these Website Terms of Use or public order. In that respect, Trinity reserves the right to delete, without prior notice, any content added to the Site which breaches these rules and, if necessary, to claim against the User, in particular in case of messages or comments of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.), or in case of a privacy violation or personal data breach.

Disclaimer of warranty and limited Liability

To the fullest extent permitted by law, Trinity makes no warranty or representation of any kind, express or implied, regarding the Site and/or any Content, data, software, materials, information, products, services and/or operation of the Site, all of which are provided on an “as is” and “as available” basis. User expressly agrees that the use of the Site is at user’s sole risk. To the fullest extent permitted by law, Trinity expressly disclaims any representation or warranty, express or implied, that the Site will be error-free, secure, uninterrupted, or virus-free.

To the maximum extent permitted by applicable mandatory laws, Trinity, its agents and/or employees will not be responsible or liable for any direct, indirect, punitive, incidental, special, or consequential loss, claim, injury and/or damage arising out of, or in any way connected with, the use of this Site, or for any information software, products, and services obtained through the Site, or any failure or delay, or the performance or non-performance by Trinity, whether based on contract, tort, strict liability, or otherwise, even if Trinity has been advised of the possibility of any loss, claim, injury and/or damage.

Changes to these Website Terms of Use

The Site is owned and operated by Trinity, and therefore, at any time and in Trinity’s sole discretion, Trinity may revise these Website Terms of Use, effective upon posting and adequate notification to User as appropriate. Continued use of the Site after adequate notice of such revisions constitutes User’s acceptance of such revised Website Terms of Use.

Personal data

Trinity ensures the protection of Users’ personal data. Trinity invites Users to read its Privacy Policy.

Applicable law and jurisdiction

If you are a consumer, please note that these Website Terms of Use are governed by the laws of the State of New York subject to any mandatory provisions of your local jurisdiction. Nothing in these Website Terms of Use affects your rights as a consumer to rely on mandatory provisions of your local jurisdiction.

If you are a business, these Website Terms of Use (and any non-contractual disputes or claims) are governed by the laws of the State of New York, and we both agree to the exclusive jurisdiction of the courts of the State of New York or the District Court of the United States having jurisdiction therein.
